Supreme Court rejects petitions to reconstitute panel probing Dubey’s encounter

The Supreme Court on Tuesday refused to remove former Allahabad High Court judge Shashi Kant Agarwal and former UP Police chief KL Gupta from the three-member inquiry commission set up to probe the encounter of gangster Vikas Dubey and his alleged associates.

Dismissing two pleas of Ghanshyam Upadhyay and Anoop Prakash Awasthi, a Bench headed by Chief Justice of India SA Bobde said it won't allow the petitioners to cast aspersion on the panel members.

It also refused to entertain a plea seeking protection for a police officer suspended and arrested for allegedly giving a tip-off to Dubey and his aides about the raid during which eight policemen, including a DSP, were killed.

It asked the wife of the suspended police officer, KK Sharma, to move the Allahabad High Court.

Headed by former Supreme Court judge BS Chauhan, the three-member inquiry commission has been asked to probe the killing of eight policemen and the subsequent encounters of Dubey and five of his alleged associates.

After perusing media reports pertaining to interviews by Gupta, the Bench said the inquiry would not be vitiated as there were former judges of the Supreme Court and High Court on the panel.
